Terms of Service

Welcome to eNotary New England. These Terms of Service ("Terms") govern your use of the remote online notarization services provided by eNotary Holdings, LLC, dba eNotary New England ("eNotary New England," "we," "us," or "our"). By using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our platform and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.

2. Description of Services

eNotary New England provides remote online notarization ("RON") services, allowing individuals to have documents notarized by a commissioned notary public via live audio-video conference. Our services include identity verification, document review, electronic notarization, and secure document handling through our third-party platform providers.

3. Eligibility

To use our services, you must:

  • Be at least 18 years of age

  • Possess a valid government-issued photo ID

  • Have access to a device with a functioning camera, microphone, and internet connection

  • Be physically located within the United States during the notarization session, as required by law

  • Not be under duress or coercion at the time of notarization

4. Identity Verification

As part of our notarization process, you will be required to:

  • Present a valid, government-issued photo ID during your session

  • Answer identity verification questions

  • Allow audio-video recording of your session as required by applicable notary laws

You agree to provide accurate, complete, and truthful information during the verification process. Failure to satisfactorily complete identity verification may result in the denial of your notarization request.

5. Notarization Process

  • Submit your documents through our secure platform prior to your scheduled appointment

  • Attend a live audio-video session with a commissioned notary public at your scheduled time

  • Appear by audio-video from a private location without other persons present, unless required by law

  • Sign documents electronically using our secure platform during the session

The notary reserves the right to decline or stop a notarization if, in their sole judgment, the session cannot be completed in compliance with applicable notary law or these Terms.

6. Payment

  • Payment is due at the time of booking and is processed securely through Stripe, Inc.

  • All fees are disclosed prior to booking and are final unless otherwise stated.

  • Additional fees may apply if extra notarial acts, witnesses, or services are requested during your session.

  • Refunds are issued in accordance with our Cancellation Policy.

7. Prohibited Uses

You agree not to:

  • Use our services for any illegal or fraudulent purpose

  • Submit documents containing false or forged signatures

  • Attempt to circumvent identity verification requirements

  • Record, reproduce, or distribute notarization sessions without authorization

  • Share your account credentials with others

  • Interfere with the proper functioning of our platform

8. Intellectual Property

All content, software, logos, and materials on our platform are the property of eNotary New England or our licensors and may not be reproduced, modified, or distributed without prior written consent.

9. Limitation of Liability

To the fullest extent permitted by law, eNotary New England and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid us for the specific service giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless eNotary Holdings, LLC, and its officers, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from your violation of these Terms or your use of our services.

11. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use of your account.

12. Termination

We may suspend or terminate your access to our services at any time, with or without cause, if we believe you have violated these Terms or applicable law. Termination does not relieve you of obligations to pay any fees owed.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Vermont, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Chittenden County, Vermont.

14. Changes to Terms

We may update these Terms from time to time. We will post the revised Terms on this page with an updated "Effective Date." Continued use of our services after changes are posted constitutes your acceptance of the updated Terms.
